1. Platform Nature
Ordoflo provides workforce management tools including scheduling, time tracking, and payroll estimation for Canadian businesses.
Ordoflo does NOT:
- Guarantee payroll accuracy
- Act as a payroll service provider
- Act as a tax advisor or legal advisor
- Submit filings to the Canada Revenue Agency (CRA) or any government body
All payroll calculations displayed in Ordoflo are estimates only and must be independently verified before use for any official purpose.
2. Employer Responsibility
Employers using Ordoflo are solely responsible for:
- Compliance with all applicable employment and labour laws
- Accurate tax remittance to the CRA and provincial authorities
- Overtime calculation and compliance with provincial employment standards
- Accuracy of employee records and compensation data entered into Ordoflo
- Disclosure of GPS tracking and monitoring to employees where required by law
- Maintaining proper employment records as required by Canadian law
3. Employee Responsibility
Employees using Ordoflo are responsible for:
- Accurate clock-in and clock-out entries
- Granting location permissions where required by their employer
- Maintaining the security of their login credentials
- Reporting inaccurate time records to their employer promptly
4. Acceptable Use
Users may not:
- Attempt to access data belonging to other companies or users
- Manipulate time records, punch data, or payroll entries fraudulently
- Reverse engineer, decompile, or disassemble the platform
- Use the platform for any purpose that violates Canadian law
- Share login credentials with unauthorized individuals
- Attempt to circumvent access controls, rate limits, or security measures
5. Account Suspension & Termination
Ordoflo may suspend or terminate accounts for:
- Fraud or attempted fraud
- Platform abuse or misuse
- Security threats or unauthorized access attempts
- Legal risk to Ordoflo or other users
- Violation of these Terms of Service
6. No Warranty
Ordoflo is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Continuous, uninterrupted, or error-free service
- Accuracy of payroll estimates or tax calculations
7. Indemnification
Users agree to indemnify and hold harmless Ordoflo, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Claims arising from employer payroll misuse or miscalculation
- Regulatory penalties caused by employer actions or inactions
- Employee disputes unrelated to platform malfunction
- Violations of these Terms of Service
- Misuse of the platform or data entered into it
8. Limitation of Liability
To the maximum extent permitted by Canadian law, Ordoflo's total liability for any claims arising from or related to the use of the platform shall not exceed the lesser of:
- The total fees paid by the user in the 12 months preceding the claim, or
- $500 CAD
Ordoflo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of whether Ordoflo was advised of the possibility of such damages.
9. Payroll Estimate Disclaimer
All payroll figures, tax calculations, and deduction amounts displayed in Ordoflo are estimates only and are NOT official payroll documentation.
These estimates are based on published CRA tax rates and provincial tax brackets. Ordoflo does not guarantee accuracy. Employers must consult a certified payroll provider or accountant for official payroll processing and CRA remittance.
10. Data & Privacy
Your use of Ordoflo is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA).
11. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Ontario, Canada.
12. Changes to Terms
Ordoflo may update these Terms of Service at any time. Users will be notified of material changes and may be required to accept updated terms before continuing to use the platform. Continued use after notification constitutes acceptance.
